Gambling in Taiwan is prohibited by the Criminal Code (Articles 266 to 268). Since 14 January 2022 Article 266 expressly covers gambling via telecommunications equipment, electronic communication and the internet, and the fine was raised to 50,000 New Taiwan dollars. Only state lotteries are legal: the Public Welfare Lottery supervised by the Ministry of Finance, and the sports lottery under the Sports Lottery Issuance Act, overseen by the Sports Administration. The Offshore Islands Development Act of 2009 allows casinos on Penghu, Matsu and Kinmen after a local referendum: Penghu rejected the plan in 2009 and 2016, Matsu backed it in 2012, but the enabling casino law was never passed and no venue has been built. Lottery prizes above 5,000 New Taiwan dollars are subject to 20% withholding tax. Online casinos are outside the law, and playing on offshore sites is a criminal offence.
